According to Article 16 of the Treaty on the Functioning of the European Union, everyone has the right to the protection of his or her personal data. The protection of individuals with regard to the processing of personal data is a fundamental right. In accordance with Article 8, paragraph 1, of the Charter of Fundamental Rights of the European Union, every individual has the right to have his or her personal data respected and protected. In addition, Declaration n˚21 sets out the rules governing the protection of personal data in the field of judicial cooperation in criminal matters and police cooperation, annexed to the Final Act of the Intergovernmental Conference that adopted the Treaty of Lisbon. Regulation (EU) 2016/679 of the European Parliament and of the Council and Directive (EU) 2016/680 of the European Parliament and of the Council set out general rules to protect individuals with regard to the processing of personal data within the EU, without providing specific rules on artificial intelligence.
